At the outset, the learned APP submits that the Sessions Judge has directed recording of evidence of the victim. In view of this, it would not be appropriate to consider the application under Section 439 of Cr.P.C. Hence, the application stands disposed of.

The learned Special Court (POCSO), Greater Mumbai shall conclude the recording of offence, as far as possible, within one year from the date of receipt of this order.
