P.C.:- 1] By an order dated 12th October 2018, the Special Court, Mumbai has granted Judicial Custody to all the three respondents. The learned APP submitted that the said order is an appealable order under section 21 of the National Investigation Agency Act. The learned APP therefore on instructions seeks leave to withdraw the present application with liberty to file a substantive appeal challenging the impugned order.

Leave and Liberty granted.

2] It is needless to mention that, for the applicant will get benefit of the provisions of Limitation Act for prosecuting a wrong remedy before a wrong forum.
