Petitioner had a valid pharmaceutical licence by the name of 'M/s. Desai Pharma' having validity upto 31.03.2023. 3.

Following inspection by the Drug Inspector on 16.05.2019, respondent No.2 cancelled the licence of the petitioner on 18.11.2019 with effect from 17.12.2019.

It is stated that petitioner has filed a statutory appeal before the State Government on 26.11.2019 but in the absence of allocation of portfolios of the Hon'ble Ministers, petitioner's appeal could not be heard.

Learned counsel for the petitioner submits that only yesterday, portfolios have been allocated.

Be that as it may, it is hereby directed that respondent No.1 shall take up the appeal filed by the petitioner on 26.11.2019 and decide the same in accordance with law within a period of 3 months from the date of furnishing an authenticated copy of this order. 1/2

During this period, the cancellation order dated 18.11.2019 shall be kept in abeyance.

As the petitioner is before the Court, let him appear before the Appellate Authority on 30.12.2019 at 3.00 p.m. 7.
