Heard both sides.

The applicant preferred an application for parole on the ground of illness of his brother. The ground was that the brother of the applicant needs spinal surgery. This Court by order dated 08/09/2016 granted parole to the applicant for a period of 30 days. Pursuant to the said order, the applicant was released on parole on 24/11/2016 for a period of 30 days. The applicant now seeking extension of the said parole for a period of 30 days.

(901)APPW5032016 The ground on which extension of parole is sought is that even though the applicant was released on parole on 24/11/2016, the operation could not have performed as his brother was suffering from Chikungunya-IGM. Learned counsel for the applicant states that under no circumstance any further extension of parole will be sought and if extension is granted for 30 days, the operation would be performed within said period. Learned counsel for the applicant categorically states that even if the operation is not performed within the extended period of parole of 30 days, no further extension of parole will be sought.

Looking to the medical certificate which shows that the brother of the applicant was suffering from Chikenguniya and the fact that he required surgery of spine, as a last chance, we are grant extension of parole for a period of 30 days.

It is made clear that under no circumstances any further extension of parole will be granted.

Application allowed in above terms.
