CORAM : NITIN JAMDAR AND GAURI GODSE, JJ.
DATE : 22 DECEMBER 2022 P.C. :
The Petitioner has challenged order passed by the Debt Recovery Tribunal against which appeal is provided for. That being the position there is no reason why writ jurisdiction should be exercised especially when the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 and the remedies provided thereunder are considered as a complete code. Writ Petition is accordingly rejected.
2.
In case the issue of limitation arises it is open to the Petitioner to point out to the Appellate Tribunal that the Writ Petition was filed and was pending.
