Heard. Learned counsel for the Applicant submits that this is a subsequent bail application. Earlier application was rejected on 6/3/2017. However, it was not pointed out that the charge is framed on 30/6/2016 and therefore this Court had given directions that in the facts of the case, the Sessions Court shall make an endeavour to conclude the recording of evidence within 10 months from the date of framing of charge. Learned counsel for the Applicant submits that although charge is framed more than 1 1⁄2 years ago, the trial has not infact proceeded. 2.
It is submitted by learned APP that the Court was vacant and therefore, there was no progress in the trial. 3.
Be that as it may, in the facts of the case, the learned Trial Court i.e. the learned Sessions Court, Thane seized with S.C. No.29/2016 shall make every endeavour to conclude the recording of evidence as far as possible by 30/7/2018.
Application stands disposed of.
