Heard the learned Counsel for the Applicant - Accused and the learned APP.

In Crime No. I701 of 2018 for the offence punishable under Sections 326, 323, 324, 504, 506, 143, 147, 149 and 427 of the Indian Penal Code the Applicant approached the learned Sessions Judge, Vasai seeking prearrest bail. On 17th August 2018 while rejecting the prayer for grant of prearrest bail, the learned Sessions Judge, Vasai in the light of law laid down in the matter of CBI V/s Anupam Kulkarni1 observed that AIR 1992 SC 1768
2/2 Yadav 909.aba.2368.18 the Applicant has remedy to appear before the court of Judicial Magistrate First Class, Vasai.

In subsequent Application before this Court being Criminal Application No. 1299 of 2018 this Court in paragraph 3 has observed thus :
"In view of this, the applicants/accused are directed to appear before the learned JMFC, Vasai tomorrow i.e. 1st November 2018 at 11.00 a.m. and till hearing on the issuance of non bailable warrant, which is to be taken up tomorrow itself, the applicants/accused are protected. The learned JMFC after hearing the accused, may pass orders which he thinks fit in accordance with law."

Instead of complying the said directions, the Applicant has moved the present Application seeking prearrest bail without change in circumstances. Rather the conduct of the Applicant appears to be contrary to the aforesaid directions issued by this Court. This Court, as such, is not inclined to grant the prayer for prearrest bail. 5.
As such, Anticipatory Bail Application is rejected. (NITIN W. SAMBRE, J.)
