This is an application by the petitioner/accused to continue interim relief granted on 20th July 2005 in the instant petition, in the wake of judgment of the Hon'ble Apex Court in the matter of Asian Resurfacing of Road Agency vs. Central Bureau of Investigation1.
Heard both sides. On 11th July 2005 the following order came to be passed by admitting the writ petition by this court (Coram : Abhay S. Oka, J.) :
"1Heard the learned counsel appearing for the parties. Arguable questions are raised considering the various decisions of the Apex Court.
2 Rule. Hearing expedited.
3 There will be interim relief in terms of prayer clause (e) so far as the Petitioners are concerned." 2018 SCC Online SC 310 avk 2/3
It is, thus, seen that after hearing both the parties, on finding that arguable questions are raised in the petition, in the light of various decisions of the Hon'
ble Apex Court, this court was pleased to admit the writ petition for final hearing. That is how, stay came to be granted in the matter.
In this view of the matter, the interim relief granted vide order dated 11th July 2005 is continued for a further period of six months.
List the petitions for final hearing.
The application is accordingly disposed off.
