Heard learned counsel for the applicant and learned APP for the State.

This is an application for pre-arrest bail in respect of the offence punishable under Section 381 of the Indian Penal Code, 1860 in connection with C.R. No.326 of 2022 dated 28/06/2022 registered with Gaondevi Police Station, Mumbai.

It is the allegation that the applicant had stolen cash from the house of the complainant and now is untraceable.

Learned APP, on instructions, submitted that even a notice under Section 41A of the Code of Criminal Procedure was issued but the house of the applicant was found locked and he is untraceable.

Learned counsel for the applicant submits that the applicant is willing to co-operate and appear in consequence of Section 41A notice. Learned counsel for the applicant, on instructions, submits that the applicant will appear before the Investigating Officer on 24/12/2022 between 11.00 a.m. and 1.00 p.m. and accept Section 41-A notice. Statement is accepted.

In this view of the matter, the Anticipatory Bail Application is disposed of.

Liberty to file an appropriate application after the applicant attends the Investigating Officer.
