Heard learned Counsel appearing for the Petitioner and the learned Counsel appearing for Respondent Nos. 9 and

10. Petition is filed seeking direction to Respondent No. 9 and 10 to register an FIR on the basis of Petitioner's complaint dated 17th August 2016, annexed at Exhibit-I to the petition. Mrs. Kantharia, having taken instructions, states that allegations made in the said complaint were gone into and conclusion is arrived at that the dispute raised therein is of civil nature. She submits that the Petitioner would be communicated accordingly within seven days from today. Statement is accepted.

In the light of above, we are not inclined to entertain this writ petition especially when the Petitioner has an alternate and efficacious remedy of approaching to the Magistrate by way of private complaint. Hence, writ petition is dismissed. [A. M. BADAR, J.] [RANJIT MORE, J.] patilsr 1 / 1
