Heard. After hearing for some time, both the counsel tendered consent minutes of order dated 27.02.2019 duly signed by the parties and their respective advocates. Same are taken on record and marked "X" for identification.

The consent minutes of order read thus:

CONSENT MINUTES OF ORDER

1. The Petitioner agrees and undertakes to this Hon'ble Court that he shall pay the sum of Rs 2,21,280/- (Rupees two lakhs twenty one thousand two hundred and eighty only) including interest @ 9 % per annum for the period October 1997 till March 2019 within three months from today in three equal monthly installments, towards monthly out goings, of the premises owned by the Petitioner in the Respondent society and further continue to pay the monthly out goings of his premises on the due dates.

2. In the event of the Petitioner failing to make the payment to the Basavraj G. Patil 1/2

27.1435.14-wp.doc Respondent as per clause (1) above this arrangement between the parties shall stand cancelled and the Respondent society shall be entitled to recover all its dues from the Petitioner with interest @ 18 % per annum.

3. In view of the facts and circumstances of this case the parties have arrived at the aforesaid terms of settlement which shall not act as precedent.

4. The above writ petition stands disposed off with the above terms.

The Writ Petition stands disposed of in terms of the consent minutes of order.

No order as to costs.
