In this case, the applicant/accused was granted pre-arrest bail by the learned Sessions Judge, Raigad-Alibag by its order dated 3rd March, 2015, as the applicant/accused is prosecuted under sections 406, 420 r/w. 34 of the Indian Penal Code in C.R. No. 9 of 2015 registered with Kharghar Police Station on the condition that the applicant shall deposit Rs.2,00,000/- with Kharghar Police Station within the stipulated time. However, the applicant did not deposit Rs.2,00,000/-, so an application was moved before the Additional Sessions Judge, Raigad-Alibag that Anticipatory Bail granted to the applicant be cancelled. Thereafter, by order dated 3rd December, 2016, anticipatory bail granted to the applicant was cancelled by the Additional Sessions Judge, Raigad-Alibag. So, this Application is moved before this Court for setting aside the order dated 3rd 1 / 2

Pursuant to the order dated 11th January, 2017, the applicant/accused was given time to deposit Rs.2,00,000/- in the registry of this Court and protection was granted till 17th February, 2017.

The learned counsel for the applicant/accused has submitted that he has deposited Rs.2,00,000/- in the High Court and produced the photocopy of two cheques dated 13th January, 2017 and 30th January, 2017, which is taken on record. Learned APP to verify about it.

In view of this, the order of granting anticipatory bail to the applicant/accused passed by the learned Additional Sessions Judge, Raigad Alibag on 3rd March, 2015 is restored, however, condition No. 3 in the said order is hereby cancelled. The applicant/accused is directed to attend the concerned police station as and when called by the Investigating officer.
