The applicant is seeking anticipatory bail in connection with C.R.No.305/2019 registered at Vishnu Nagar Police Station, Dombivali, District-Thane dated 6.11.2019 under Section 381 of the Indian Penal Code.

The allegations against the applicant are that she was working as a maid with the complainant since past few years. In October, 2019, the complainant realized that golden chain weighing seven tolas worth Rs.1,40,000/- was missing Deshmane (PS)

from her house. The accused was a suspect and, therefore, this FIR was lodged.

Today, nobody appears for the applicant.

The applicant was granted interim protection by this Court (Coram: Sandeep K. Shinde, J.) vide order dated 12.12.2019.

Today, learned APP produced a report of the investigating officer attached to Vishnu Nagar police station, Dombivali, District-Thane which is taken on record and marked "X" for identification. It is mentioned in the report that there was no specific evidence in this case against the applicant and, therefore, "A" summary report was filed before a competent Court and it was accepted by that Court. Therefore, nothing survives in this application. 6.

Since the investigating agency does not want the applicant's custody, there is no question of granting anticipatory bail in this case. Therefore, the application is disposed of. However, it is made clear that if in future the

investigating agency decides to arrest the applicant in connection with the same offence, the investigating agency shall give four clear working days' notice to the applicant to enable her to take appropriate steps in accordance with law for protecting herself.
