This petition has been filed by the Darukhana Sand Merchant Association. There is no averment that the Petitioner/Association is registered under any law. Moreover, we find that even assuming that the Association is registered, the Association is not affected in any manner by the registration of the impugned FIR. 2.

The First Information Report alleging the offence under section 379 has been lodged against the members of the association. Hence, this petition under Article 226 of the Constitution of India read with S.482 of the Code of Criminal Procedure, 1973 cannot be entertained and is accordingly dismissed.
