The above Civil Application has been filed for interim stay of the award passed by the Reference Court pending the above First Appeal. There would be interim relief in terms of prayer clause (b) on the condition that the Applicant/Appellant deposits the entire decreetal amount in the Reference Court i.e. the Learned Civil Judge Senior Division, Alibag within 12 weeks from date. If, the amount is deposited, the Claimants would be at liberty to file an application for withdrawal which would be considered on its own merits and in accordance with law.
