The dispute it appears to be concerning retiral benefits. The same dispute it appears is because of discrepancies in the service book as claimed by the Petitioner.
The grievance of the Petitioner was with the Registrar of the Maharashtra Council of Homeopathy. The learned counsel for Maharashtra Council of Homeopathy submits that the said Registrar 1/3
against whom the Petitioner had grievance is not in service. Other person has been appointed as Registrar. Administrative Officer of the Council is also officiating.
The learned counsel for the Petitioner submits that let the service book be verified by the Administrative Officer of the Maharashtra Council of Homeopathy. The learned counsel for Respondent no.2 also does not have any objection with regard to the same. In view of that, Petitioner may submit the service book for verification with the Administrative Officer of the Maharashtra Council of Homeopathy, Mumbai. Administrative Officer shall verify the service book and shall consider the grievance of the Petitioner with regard to the service book and shall take decision upon it. Same shall be verified preferably within 8 weeks from the date of submission of service book to him. Further steps be undertaken pursuant to the verification of the service book by the Administrative Officer. The Petitioner if he is entitled for the benefit after verification of the service book by the Administrative Officer then the parties thereafter shall take further steps. In that event, all contention raised by the respective parties are kept open. Writ Petition is disposed of. No costs.
