This is an application for bail in C.R. No. 302 of 2016 registered with Dattawadi Police Station, Dist. Pune for offences punishable under Section 467, 471, 420, 465 & 417 of Indian Penal Code.

The offence was registered on 7th August, 2016. Complainant is employee of State Bank of Hyderabad. It is alleged that the applicant/accused had applied for housing loan from the said bank. On 8th March, 2014 the accused had availed loan of Rs. 1,08,00,000/-. It is alleged that entire amount involved in the offence is to the tune of Rs. 1,33,00,000/-. 3.
Learned counsel for the applicant and learned APP brought to my notice order dated 08th March, 2019 passed by this Court
Sajakali Jamadar 2 of 2 949-BA-3524-2019.doc granting bail to co-accused Ganesh Waghere and the order passed by this Court in Anticipatory Bail Application No. 207 of 2019. On perusal of the of the said order it is apparent that the applicant/accused Ganesh Waghere had volunteered to deposit the amount of Rs. 28,00,000/- and the other accused Sagar Nadhe had deposited the amount of Rs.1,05,00,000/-. The amount allegedly misappropriated by obtaining loan of Rs. 1,08,00,000/-. The applicant is in custody from 23rd July, 2018. The investigation is completed and the charge-sheet is filed. All the offences are triable by the Magistrate. Handwriting report is also obtained. Further detention of the applicant is not necessary. Case for grant of bail is made out.

Hence, I pass the following order :
O R D E R
i) Bail Application No. 3524 of 2019 is allowed; ii) The applicant is directed to be released on bail in connection with C.R. No. 302 of 2016 registered with Dattawadi Police Station, Dist. Pune on furnishing P.R. bond in the sum of Rs. 25,000/- with one or more sureties in the like amount; iii) Application stands disposed of accordingly.
