By this present Petition, under Article 226 of the Constitution of India the Petitioner has prayed for quashing of charge-sheet bearing C.C.No.906/SS/15 pending on the file of learned Metropolitan Magistrate, Borivali, Mumbai, arising out of C.R. No.337 of 2014 registered with MHB Colony Police Station, Mumbai.

The Petitioner is having substantive alternate remedy by way of filing an Application for discharge before the Trial Court and without availing said remedy he has directly approached this Court by invoking jurisdiction under Article 226 of the Constitution of 1/2

In view thereof, the learned Advocate for the Applicant on instructions seeks leave to withdraw the present Petition with liberty to file Application for discharge before the Trial Court. Leave and liberty granted.
