In view of the averments made in the application, a case for restoration is made out. Accordingly, application is allowed in terms of prayer clauses (a) and (b), subject to the condition that the applicant will supply spare copy for service to the second respondent within three weeks from today. If compliance is not made, order of dismissal shall stand. If compliance is made, notice be issued to the second respondent in the main application, returnable on 2nd March, 2017.
