Heard Mr.Y.P. Narvankar, learned counsel for the petitioners and Mr.A.B. Kadam, learned A.G.P. for the respondents-State, at length. 3.

This Petition takes exception to the order dated 30.10.2018 passed by the Joint Charity Commissioner, Pune Region, Pune in Application No.5/2018. By that order, the Joint Charity Commissioner rejected the application made by the petitioner under Rule 36(3) of the Maharashtra Public Trusts Rules for transfer of proceedings from 1 / 2

504.WP.13164-18.doc Assistant Charity Commissioner-II to any other Assistant Charity Commissioner or Deputy Charity Commissioner.

After arguing the petition for quite some time, Mr. Narvankar seeks permission to withdraw this Petition with liberty to challenge the order of the Assistant Charity Commissioner-II in case it is adverse to the petitioners' interest keeping all contentions raised in this petition open in such proceedings.

In view thereof, on the motion made by Mr. Narvankar the petition is allowed to be withdrawn and is disposed of as such. In case, the Assistant Charity Commissioner-II decides the proceedings against the petitioners herein all contentions raised by the petitioners in this Petition are allowed to be agitated in the proceedings proposed to be filed against the final order of the Assistant Charity Commissioner-II. Order accordingly.
