IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION ANTICIPATORY BAIL APPLICATION NO. 2376 OF 2018 Jayprakash Chandayya Bhandari .....Applicant V/s.

The State of Maharashtra and another .....Respondents Mr. Rishi Bhuta i/b Mr. Ujjwal Gandhi for the Applicant Mr. R. M. Pethe APP for the State Ms. Dipali Patil, API, Vile Parle Police Station CORAM : NITIN W. SAMBRE, J.

DATE :

22nd NOVEMBER, 2018.

P.C.

Heard the learned counsel for the Applicant who is seeking pre-arrest bail in crime no. 136 of 2017 registered with Vile Parle Police Station for offence punishable under Sections 467, 468, 471, 420 r/w 34 of the Indian Penal Code.

In my opinion, no case for grant of bail is made out for the following reasons:

2 911.2376.18 aba.doc (a) The Applicant appears to be the handler of the person namely Mahesh Gupta who is instrumental in pursuing the relevant documents with the Customs Department which later on turned out to be forged one.

(b) The Applicant has handled the said file containing forged documents, the origin of which needs to be investigated into, for which the custodial interrogation of the Applicant is must. In view thereof, no case for pre-arrest bail is made out. The Application is rejected.
