By this writ petition under Article 227 of the Constitution of India, petitioner/original defendant Nos. 13 and 17 challenges the order dated 15.06.2017 passed by the learned Civil Judge, Junior Division, Dahiwadi below Exhibit-173 in Regular Civil Suit No.218 of 2000 rejecting their application under Order 12 Rule 6 of Civil Procedure Code, 1908.

After arguing for some time, learned Counsel for petitioner took instructions from his client who is present in Court and makes a statement that he do not want to press the present writ petition. He further submits that in view of the facts of the present case this Hon'ble Court be pleased to expedite the hearing S.C.Magar

Considering the submissions made by learned Counsel for petitioner and the statement made before this Court, following order is passed :

a) Writ petition stands disposed of as withdrawn. b) Hearing of Regular Civil Suit No.218 of 2000 pending before Civil Judge, Junior Division, Dahiwadi is expedited.

c) This Court expect the trial Court to decide the Regular Civil Suit No.218 of 2000 on its own merits as earlier as possible, but in any case on or before 31.07.2019. d) Parties to act on authenticated copy of this order.
