The applicants are seeking anticipatory bail in connection with C.R.No. 17 of 2019 registered at Malad Police Station, Mumbai, under sections 420, 186 and 189 of the Indian Penal Code.

Heard Mr. Iftekhar Sayed, learned counsel for the applicants and Smt. G.P. Mulekar, learned APP for the State.

The gist of the allegations in the FIR are that the applicants were acting illegally as agents and were taking money from the people in the area for doing ration card job. The FIR mentioned certain instances when they had taken money from the people in the area. Both of them had also caused disturbance in the office of the first informant who was a Rationing Officer. 4.

Both the applicants were protected by the interim order dated 16/12/2019 passed by this Court (Coram: Sandeep K. Shinde J.). In the said order it is mentioned that learned Counsel for the applicants had shown willingness to file undertaking that the applicants would not indulge in similar acts in future. Such undertaking is filed by the applicants. It is in the record of this application. The undertaking is dated 19/12/2019. 5.

Learned APP on instructions, makes a statement that since then, there is no further disturbance from the applicants. They have stopped acting as agents. It is categorically submitted by learned APP that the Investigating agency does not want

applicants'

custody for further investigation.

In this view of the matter, interim protection granted to the applicants, can be made absolute.

Hence the following order.

O R D E R

(i) In the event of their arrest in connection with C.R. No. 17 of 2019, registered with Malad Police Station, the Applicants are directed to be released on bail on their furnishing PR bonds in the sum of Rs.30,000/- each (Rupees Thirty Thousand Only) with one or two sureties each in the like amount.

(ii) The Application stands disposed of accordingly. (SARANG V. KOTWAL, J.)
