The learned counsel for the applicant, after arguing for some time, seeks liberty to withdraw the application on the ground that chargesheet has been filed during the pendency of this application. The prayer is fair enough. Liberty as prayed for is granted with further liberty to file an appropriate application under Section 439 of Cr.P.C. before the Sessions Court in the changed circumstances. The application stands disposed of as withdrawn.
