The applicant is apprehending arrest in Crime No. I193 of 2018 registered with Uran Police Station on 6th October, 2018 for the offences punishable under Sections 395, 323, 504 read with Section 34 of the Indian Penal Code.

Heard learned Counsel for the applicant and learned APP for the State.

Perused the order dated 22nd November, 2018 passed by this Court whereby the applicants were granted interim relief on certain terms.

The learned Counsel for the applicant has brought to my notice, Affidavit filed by the complainant sworn on 10th October, 2018 whereby he has stated that the amount allegedly robbed was later on found in his car and that the complaint was filed by him inadvertently. It is submitted that the co-accused in the same crime were granted bail by the learned Judicial Magistrate First Class, Uran on the strength of the said Affidavit which is at page25 of the said petition. Hence the following order :
O R D E R
(I) The application is allowed In the event of the arrest of the applicants in Crime No. I-193 of 2018 registered with Uran Police Station on 6th October, 2018 for the offences punishable under Sections 395, 323, 504 read with Section 34 of the Indian Penal Code, they be released on executing P.R. Bond of Rs.25,000/- each with one or two sureties in the like amount.
3/3 ABA-2386-2018 (SR.911) (II) The applicants shall not tamper with the prosecution witness and co-operate with the investigation.
