Heard learned counsel for the Applicant and the learned APP for the Respondent - State. 2.

By this Application, the Applicant seeks his enlargement on bail pending the hearing and final disposal of the aforesaid Appeal. Learned counsel for the Applicant states that the Appellant has been convicted for the offence punishable under Section 304 Part I of

the I.P.C. and has been sentenced to suffer R.I. for ten years and to pay a fine of Rs.2,000/-, in default to suffer further R.I. for two months. He submits that the Applicant was on bail pending the trial and has not misused or abused his liberty. He further submits that out of the said sentence, the Applicant has already undergone two years rigorous imprisonment. He submits that the Appeal is of the year 2015 and is not likely to be heard in the immediate near future and prays that considering the peculiar facts of this case, the Applicant be enlarged on bail pending the hearing and final disposal of this Appeal.

Perused the papers. Considering the peculiar facts of this case, the Application is allowed and the Applicant's sentence is suspended and he is enlarged on bail on the following terms & conditions:-

O R D E R

(i) The applicant be enlarged on bail, on executing PR Bond in the sum of Rs.15,000/- with one or two local sureties in the like amount; (ii) The applicant shall attend the concerned trial Court on the 1st Saturday of every third month;

(iii) The applicant shall inform his latest place of residence and mobile contact number immediately after being released and/or change of residence or mobile details, if any, from time to time to the Court where he will be reporting as per Clause (ii).

Accordingly, the Application is allowed and disposed of.
