Heard Mr.Daulat Khamkar, the learned counsel for the applicant / appellant, who submits that, the applicant /appellant is in custody for a period of about 3 years and 6 months. He submits that, however, he would not press the application for avk 1/2

12-APPA-1956-2012 suspension of sentence, but would instead, urge that the appeal itself be taken up for Final Hearing at the earliest. This seems to be reasonable.

It is directed that the appeal be listed for 'Final Hearing' peremptorily on 10th February, 2015, at 3.00 p.m. In view of this, the Criminal Application No.1956 of 2012 is allowed to be withdrawn, and stands dismissed as such. (ABHAY M. THIPSAY, J.) avk 2/2
