IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION APPEAL FROM ORDER NO. 223 OF 2016 WITH CIVIL APPLICATION NO. 298 OF 2016 Aditya Ajit Phadke ...Appellant

Versus

Designated Officer-III & Anr

...Respondents

Mr Rushil Mehta, for the Appellant.

Mrs Madhuri More, for the Respondent No. 1-MCGM. CORAM: G.S. PATEL, J DATED:

17th July 2017 PC:- 1.

Ad-interim reliefs were refused in November 2015. There is no protective order in appeal. Clearly, no interference is warranted at this stage except to say that the Notice of Motion itself will be disposed of at the Trial Court's earliest convenience on its own merits uninfluenced by the ad-interim order under Appeal. All contentions are kept open.

2.

The Appeal from Order and the Civil Application are both disposed of in these terms. There will be no order as to costs. 17th July 2017

28-AO223-16.DOC 3.

All concerned to act on an authenticated copy of this order. (G. S. PATEL, J) 17th July 2017
