FINAL ORDER:- Upon hearing the learned counsel appearing for Respondent No. 5, we are inclined to dispose of the present Writ Petition, as it becomes infructuous in view of the subsequent development.

In the present Petition, the main challenge is to the impugned communication dated 10 December 2015 whereby, the tender to excavate the sand was awarded in favour of Respondent No.5 for the year 2015-2016. This Court, on 7 January 2016, after 1/2

ssm 2 902-wp272.16.sxw hearing the parties not granted any interim relief. The Writ Petition is pending since then.

In view of the fact that the tender was only for one year i.e. upto 30 September 2016 and as it was already awarded to Respondent No.5, we see there is no reason to keep this Petition pending for any purpose. Writ Petition is accordingly disposed of, as infructuous. No costs.
