Inspite of service none appears for the Respondent No. 2. This Application is filed seeking condonation of delay of 2 years and 3 months caused in filing the appeal.

It is stated that in the Application at the time of Judgment and since the trial he is in jail. There is no one to look after the family members were not aware of the remedy of filing of appeal for these reasons delay is caused.

Considering the reasons assigned and the fact that the Applicant is in jail, delay deserves to be condoned. The Interim Application no. 4660 of 2023 is therefore allowed and disposed of. Delay stands condoned.
