At the outset the learned APP submits that in the present case i.e. in Sessions Case No. 258 of 2013 pending before Additional Sessions Judge, Kalyan, the Court has recorded substantive evidence of one witness. The trial is in progress. 2) In the midst of trial, it would not be appropriate to consider an application seeking enlargement on bail under section 439 of Code of Criminal Procedure, 1973.
