It is submitted that after filing of the petition, chargesheet has been filed. We have perused the FIR. It seems that the complainant had grievance that after they entered into the settlement by which they got mutual divorce by executing certain documents, the Petitioner husband retained some of the articles which he was supposed to hand over to the complainant. Learned counsel appearing for the Petitioner submits that all those articles were handed over to the complainant. In the facts, if the charge-sheet is filed, we are of the view that the petitioner would resort to alternate statutory remedy as prescribed in the Code of Criminal Procedure. Keeping all issues on merits open, petition is disposed of.
