Heard learned Counsel for the parties.
After arguing for some time, the learned Counsel for the petitioner submits that the Respondent may be directed to allow the petitioner to use their FSC Certificate on page 29 Exh.D at the time of participating in tender process as per Respondent's advertisement No. 912 dated 16.12.2016.
The learned Counsel for the Respondent Nos.
1 and 2 submits that they have no objection, petitioner may rely on the same FSC certificate, but Respondents have to process the tender according to Sneha Chavan 1/2
916 wpst 35554-16=.doc order dated 08.12.2016 passed by the Division Bench of High Court of Judicature at Bombay, Nagpur Bench in PIL No. 160 of 2016.
Considering this fact, following order is passed.
a) Petitioner is permitted to use FSC Certificate which is on page 29 Exh.D in the present proceeding at the time of participating in tender dated 16.12.2016 issued by Respondent No.1 subject to order dated 08.12.2016 in PIL No. 160 of 2016 (Nagpur Bench).
b) Writ Petition stands disposed of accordingly.
