Applicant - Accused and Respondent No. 2 - Complainant are present and identified by Mr. Kotnis, Advocate. 2.

They were business partners and dispute under Section 138 of the Negotiable Instruments Act, 1881 is settled amicably in National Lokadalat in Sessions Court vide Criminal Appeal Nos. 81 of 2017 to 83 of 2017.

The Consent Terms then reached also envisaged

APL 1358-18.doc quashing of present FIR. Accordingly, Respondent No. 2 has tendered an Affidavit even in present matter. 4.

In this situation, accepting the joint request, we quash and set aside the FIR No. 217 of 2013 dated 20.06.2013 and Criminal Case No. 54/PW/2014 pending in 12th Court of Metropolitan Magistrate at Bandra, Mumbai.
