Heard learned AGP for the applicant. None for the respondent, though duly served.

This application is preferred by State of Maharashtra for restoration of First Appeal No. 1864 of 2010, which was stands dismissed in view of conditional Order dated 23.12.2010 passed by this Court for non filing of private paper book.

The learned AGP submits that private paper book is ready. They undertake to file the same within two weeks from today. The statement is accepted.

Considering the submissions made by learned AGP for the applicant and averments made in civil application, I am satisfied that applicant has made Sneha Chavan 1/2

i) Civil Application is allowed in terms of prayer clauses (b) & ( c) which read thus:

"b) that this Hon'ble Court be pleased to condoned the delay in preferring above mentioned Civil Application for restoration of above mentioned First Appeal No. 1864 of 2010.

c) That this Hon'ble Court be pleased to restore the above mentioned matter on file and allow the applicant to file paper book as per order dated 23.12.2010 passed by this Hon'ble High Court." ii) Applicant to file private paper book within two weeks from today.

iii) Civil Application stands disposed of accordingly.
