3] There is however, no case is made out for grant of any interim reliefs in this petition. The impugned order was made on 22nd October 2016 since then, there is no interim relief in operation. Even otherwise, no case has been made out for grant of interim relief.

4] However, it is made clear that pendency of the present petition should not hinder the progress in Suit No. 1086 of 2014 before the learned Trial Judge, in fact, learned Trial Judge should proceed with the suit and an endeavour shall 1/2

Dinesh Sherla 18-cwp-1597-17 be made to dispose of it, on its own merits and in accordance with law without being influenced by the impugned order or the present order by which the interim relief is being declined to the petitioner.

5] Liberty to apply, in case the petitioner wants this petition to be disposed of with directions for expeditious disposal of the suit.
