The learned Government Pleader on instructions of Shri Sunil Pathak, Section Officer, Urban Development Department (UD-1) who is personally present in the Court states that the order passed by the State Government which is communicated by the letter dated 8th September 2015 (Exhibit-C to the Petition) is withdrawn. We accept the said statement.

The learned counsel appearing for the Petitioner submits that the effect should be given to the withdrawal of the said order. The order of the State Government is already withdrawn. If the Petitioner finds that the effect is not given to the said order, it is for him to adopt appropriate proceedings.

Subject to what is observed above, the Petition is disposed of. All contentions of the parties on merits are kept open. Disposal of this Petition will not prevent the Petitioner from making appropriate representation to the concerned Authorities on the issues raised in the Petition.
