2.
By this Petition, the Petitioners are challenging the notice dated 4.12.2016 issued by the Senior Police Inspector, Malad police station under section 149 of the Code of Criminal Procedure, 1973. 3.
The object behind issuance of notice under section 149
RNG 5-4534.16.doc of the Code of Criminal Procedure 1973 is to prevent commission of of cognizable offences. In pursuance of a complaint filed by one Nitu Manish Sharma, a non cognizable complaint is registered against the Petitioners under the provisions of sections 504,506 and 323 of the IPC. On the basis of this, the Petitioner was issued the impugned notice under section 149 of the Code of Criminal Procedure, 1973. 4.
In the above circumstances, we do not find any merit in the Petition. The Petition is accordingly dismissed. (SARANG V. KOTWAL, J.) [RANJIT MORE, J.]
