The grievance of the petitioner is that his application for stay filed on 29.11.2016 in the pending Appeal No.806 of 2016 filed before respondent no.1 against the judgment and award dated 24.8.2016 passed by the authorized officer under section 88 of the Maharashtra Cooperative Societies Act, 1960 has not been considered and decided by respondent no.1 as yet. The petitioner

p-10-wp-121.2017.sxw submits that in the absence of any stay order, there is every likelihood that the order impugned in the appeal will be implemented.

Keeping in view the aforesaid, we dispose of this petition by directing the respondent no.1 to consider and take appropriate decision, in accordance with law, on the petitioner's application for stay filed in the pending appeal No. 806 of 2016 as expeditiously as possible but not latter than 15 days from the date of receipt of copy of this order. It is also open for the respondent no. 1 to decide the appeal itself as expeditiously as possible. 5.
