The learned counsel for the applicant submitted that when the trial court passed the order dated 26.11.2015, the copies of the statements of witnesses recorded under Section 164(1) of the Cr. P. C. were not made available to his clients. He on instructions submits that now the copies are made available to them. In view of the change in circumstance, he seeks leave to withdraw the present application with liberty to file a fresh application for bail before the learned Trial Court. Leave and liberty granted. Application is dismissed as withdrawn. The learned Trial Court to consider the said application on its own merits. (A.S. GADKARI, J.)
