DATED : 3 FEBRUARY 2023 P.C. :- This is an application under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail.

The applicant is apprehending his arrest in Crime No. 275 of 2022 registered at Khadak Police Station, Pune for the offences punishable under Sections 143, 147, 149, 323, 324, 326 & 504 of the Indian Penal Code.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

According to the prosecution, on the date of incident, which took place on 9 September 2022 on account of previous dispute the present MJ Jadhav 1 / 2

43-ABA-3513-22.odt applicant and other co-accused assaulted the complainant by some sharp weapon and caused him grievous injury.

The alleged grievous injury is not attributed to the present applicant. Nothing is to be recovered at the instance of the applicant. Therefore, there is no need of custodial interrogation. There are no other criminal antecedents. Considering the facts and circumstances of the case, I am inclined to release the applicant on anticipatory bail. Hence, the following order is passed:

(i) Application is allowed.

(ii) In the event of arrest of applicant- Pruthviraj Sachin Kondhare in Crime No. 275 of 2022 registered at Khadak Police Station, Pune for the offences punishable under Sections 143, 147, 149, 323, 324, 326 & 504 of the Indian Penal Code, he shall be released on bail on furnishing PR bond in the sum of Rs. 25,000/- with one or two sureties in the like amount. (iii) The applicant shall attend the concerned police station as and when called by the Investigating Officer and shall co-operate in the investigation. ( N.R. BORKAR, J. ) MJ Jadhav 2 / 2
