IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CONTEMP PETITION NO.8 OF 2016 Kamla Omprakash Kanaujia

...Petitioner

vs.

Hemant Sawant and Ors.

...Respondents

---- None for the Petitioner.

---- CORAM : B. P. DHARMADHIKARI & REVATI MOHITE DERE, JJ.

DATE : 04/02/2019.

P.C.:

.

Nobody for the petitioner even on second call. 2.

On 10/4/2017 this Court has affirmed view of Committee of Registrar that the petitioner cannot be permitted to appear in person and therefore was given time of 6 weeks to engage an advocate. On 4/6/2018 as nobody appeared the matter was adjourned to 16/7/2018. The matter was adjourned because the petitioner claimed that Transfer Petition was filed before the Hon'ble Apex Court. On 16/7/2018 the matter was adjourned to 14/1/2019 and on 14/1/2019 petitioner took adjournment on the ground that her advocate is not available. The Hon'ble Apex Court has on 3/12/2018 refused to intervene in the matter and requested this Court to expeditiously take up contempt petition. 3.

As noted supra the petitioner is absent even in second half. 4.

The grievance of the petitioner appears to be about statement made before this Court. It is claimed that respondent No.1 police inspector

rsk 2/2 36-CONP-8-16.doc had stated that "mobile was sent to Forensic Science Laboratories in view of conversation" but report is not of conversation but of MMS. The said report is in negative as MMS could not be found in audio record. It is claimed that this is contempt.

5.

We have perused the petition and find it difficult to note any contempt. Hence the petition is dismissed.
