This is an application for suspension of sentence and releasing the applicant/accused on bail during pendency of the appeal filed by him which is admitted for final hearing. Heard the learned Advocate appearing for the applicant/accused as well as the learned Additional Public Prosecutor appearing for the respondent/State. Kavita Page 1 of 3

The applicants are convicted of offences punishable under Sections 498-A, 306 r/w 34 of the Indian Penal Code. On both count they are sentenced to suffer simple imprisonment for three years apart from imposing some fine and sentence in default of payment of fine. All applicants are already released on bail by the learned Trial Court as the sentence imposed on them is only for three years. 3.

Short sentence of imprisonment is imposed on the applicants and they are already released on bail by the learned Trial Court by suspending the sentence under Section 389 of the Code of Criminal Procedure.

The appeal filed by them is not likely to be heard within a short period of three years. Therefore, the Order : (i) The application is allowed.

(ii) The substantive sentence of imprisonment imposed on Kavita Page 2 of 3

the applicants/accused are suspended and they are directed to be released on bail on their executing P.R. Bond in the sum of Rs.15,000/- each and on furnishing surety in the like amount by each of the.
