P.C.:
.
On 25/2/2020 in these two petitions learned APP was given time to find out antecedents of the parties. As the parties did not appear, the matter was to be placed today. Today the parties are present. 2.
The complainants in counter FIR's are real brothers and dispute arose on account of the family property. That dispute is already resolved after Consent Terms were filed in pending Second Appeal. That Second Appeal is already disposed of. Very same Settlement Deed is also produced on record of present proceedings with joint request to quash and set aside the criminal proceedings instituted against each other by parties.
rsk 2/2 501-WP-6320-6321-19.doc 3.
As noted supra the parties are present with their respective advocates and orally also they have reiterated the request. Complainant Kailashchandra Dangra, who is respondent No.2 in Criminal Writ Petition No.6321/2019 has filed affidavit giving no objection for quashing of his FIR.
4.
In this situation, as parties appear to have filed police complaints against each other and public time and money is lost, we direct complainants in both the matters to pay Rs.20,000/- each to the Police Welfare Fund, State of Maharashtra within two weeks from today. 5.
Subject to such payment, we make Rule absolute in terms of prayer clause (a) in both the petitions.
(N. R. BORKAR, J.) (ACTING CHIEF JUSTICE)
