1] This is an application for cancellation of anticipatory bail granted to respondent no.1 by the learned District Judge-4 & Additional Sessions Judge, Kalyan by its order dated 29th November, 2017 in ABA No.1620 of 2017.

2] The learned APP submitted that a report dated 24th January, 2018 has been received by him through the Police Inspector, Crime Branch Unit no.4, Ulhasnagar wherein it is stated that after conducting investigation it is revealed that respondent no.1 has not played any role in the present crime. 1/2

sr.26.appln.710.20172017.doc There is no evidence against him and therefore he has been made as a witness in the present crime. The Investigating Agency is in the process of submitting the report under section 169 of Cr.P.C. before the concerned Court in this behalf.

2] In view thereof, the present application does not survive and is accordingly disposed off.
