Heard the learned counsel for the Petitioner and the learned APP for the State.

This petition is filed seeking direction against the Respondent no.5 to register F.I.R. against the Respondent nos.6 to 11 on the basis of Petitioner's complaint dated 12.8.2015.

Mrs. Deshmukh, the learned APP, on instructions of the concerned officer who is present in the Court states that by the letter dated 16.12.2015, the Investigating Officer, Versova Police Station called Shivgan

*2* 912-WP-5068-2015.doc the Petitioner for recording her statement and despite the said letter, the Petitioner has not approached the said police station. The counsel for the Petitioner having taken instructions from the Petitioner, who is present in the Court states that the Petitioner will approach Investigating Officer, Versova Police Station day after tomorrow i.e. on 21st January, 2016 at 11.00 a.m.. Statement accepted. Mrs. Deshmukh the learned APP further makes a statement that the concerned Investigating Officer shall examine the statement of the Petitioner that would be recorded in pursuance of the above directions and an appropriate decision would be taken and the same will be communicated to the Petitioner at the earliest. Statement accepted. In the above circumstances, the grievance of the Petitioner no more survives and the Petition stands dismissed. (A. K. MENON, J.) (RANJIT MORE, J.) Shivgan
