Heard Mr. Sud, petitioner in person and Mr. Kadam, learned A.G.P, for respondents No.1 and 2.

The matter was heard on 28th January, 2019. After considering the prayers made in the Petition, it was indicated to the petitioner that the Court is not inclined to entertain this Petition. During the course of the hearing, Mr. sud sought leave to amend so as to challenge the judgment and decree dated 28th August, 2013 passed by the learned trial Judge in R.A.D. Suit No.264 of 2013 as also execution in pursuance of that decree. It was indicated to the petitioner that he has remedy of filing substantive appeal against the said decree as also challenging execution in pursuance of that decree. Mr. Sud, therefore, seeks permission to withdraw this Petition. He submits that he will file substantive appeal challenging the decree and execution in pursuance of that decree.

In view thereof, on the motion made by Mr. sud, the Petition is allowed to be withdrawn and as such is disposed of. It is made clear that I have not examined merits of the case. Order accordingly. [R.G. KETKAR, J.]
