The learned APP, on instructions of Shri Vilas Jadhav, P.I. attached to S.B.I. C.I.D., submits that the trial Court pertaining to CR No.430 of 2013 registered with Tilaknagar Police Station, Mumbai has already commenced and as of today five witnesses have been examined by the prosecution. In view of the said statement, the learned Counsel for the applicant, on instructions, seeks leave to withdraw the present application with liberty to file a fresh bail application, if the trial does not conclude within a period of one year from today. Leave and liberty granted. The application is disposed of in the aforesaid terms.
