..Applicant.
vs.
Mrs. Rupa U. Sinha.
..Respondent.
Mr. Tejas J. Kapre with Mr. J.S.Kapre for the Applicant. Mr. S.S.Katdare i/by Kuldeep U. Nikam for the Respondent. CORAM : R.M. BORDE AND A.S. GADKARI, JJ.
DATE : 19th January, 2017 PC:
These are applications seeking condonation of delay in presenting the appeal challenging the order passed by the Family Court. The delay is one year and eighty six days. 2.
Heard Counsel for the parties.
3.
Since the dispute relates to matrimonial disharmony between the parties and the order under challenge is in respect of grant of decree of divorce against the appellant, we deem it appropriate to condone the delay in order to meet the ends of justice.
2 /2 CAM-84-85-16-15 4.
Both the applications have been vehemently opposed by the counsel appearing for the respondent. It is the contention of the respondent that no proper reasons have been set forth for granting indulgence in favour of the applicant, however, considering the contentions of the applicant, both the applications are allowed and the delay of one year and eighty six days stands condoned.
5.
List the Family Court Appeal on 31.1.2017.
