The learned counsel for the applicant, on instructions, submits that the applicant intends to approach the learned Sessions Judge in Revision under section 397 of Code of Criminal Procedure, 1973 ("Cr.P.C." for short) inasmuch as the Division Bench of this Court in the case of Avinash Trimbakrao Dhondage v. State of Maharashtra, 2015 (3) ABR (Cri) 901 has held that the order passed under section 156 of Cr.P.C. is
skn 2/2 1384.15-apl-- revisable. Accordingly, the learned counsel seeks permission to withdraw this application with liberty to approach the Sessions Court. In the circumstances, the application is disposed of as withdrawn with liberty as prayed.
